1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of phototopassport.com (the “Service”). You must have legal capacity to accept these Terms. If you use the Service for a child or another person, you confirm you are authorised to act for them and to use their photograph.

2. Description of Service

Photo to Passport is a free browser-based cropping, framing, background, adjustment, and print-sheet tool. On-device face detection is used only to suggest framing, not to identify or recognise a person. Photos, face landmarks, masks, canvas contents, and other image-derived data remain on your device and are not uploaded or stored by the Service.

Photo to Passport is an independent service. It is not affiliated with, endorsed by, approved by, or acting for any government, passport authority, embassy, or consulate.

3. No Guarantee of Acceptance

Output is not government-approved and acceptance is not guaranteed. Requirements vary by country, application route, age, location, and format, and they change over time. Some authorities prohibit altered, AI-edited, home-printed, or non-professionally taken photos. You must follow the current instructions from the issuing authority and decide whether this tool is suitable before submitting or printing an output.

4. User Responsibilities

By using the Service, you agree that:

• You own the photograph or have all permissions and legal authority required to use it, including for a child’s photograph.
• You will respect the photographed person’s privacy and will not use their image unlawfully.
• You will not use the Service for any unlawful purpose, including creating fraudulent identity documents.
• You will not attempt to reverse-engineer, scrape, or otherwise misuse the Service.
• You are responsible for verifying that the output meets the requirements of the authority to which you intend to submit it.

5. Intellectual Property

The website design, code, text, and branding of Photo to Passport and its licensors are protected by applicable intellectual-property laws. You retain any rights you have in a photograph. The Service receives no licence to, and does not receive, upload, store, sell, advertise with, or train models on your photograph.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PHOTO TO PASSPORT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Rejection of a passport photo by any government authority or institution
• Delays in passport or visa applications resulting from photo rejection
• Any costs, fees, or losses arising from reliance on the Service output
• Loss of data or inability to access the Service

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that rule, the Service is free and our aggregate liability will not exceed the amount you paid us for the Service.

8. Indemnification

You agree to indemnify, defend, and hold harmless Photo to Passport and its operators from and against any claims, liabilities, damages, losses, and expenses arising out of or connected with your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

9. Third-Party Links

The Service may reference or link to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites. Links are provided for informational purposes only.

10. Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We shall not be liable for any modification, suspension, or discontinuation.

11. Governing Law

These Terms shall be governed by applicable law. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects any changes. Continued use after changes are posted constitutes acceptance of the updated Terms.
